CONDITIONS UNDER WHICH YOUR ORDER IS ACCEPTED
(a) No Claim of any kind for any reason whatsoever will be accepted by us for non-fulfillment, or late delivery, of this order or any part thereof. (b) Where goods not required by reason Of late delivery you are to contact us immediately for disposal instructions, and not to return them without our written consent. (c) Where faulty goods are involved you are to supply us with a list of such items, quoting the invoice on which they were supplied (to comply with VAT. requirements) and await written disposal instructions from us. (d) PILFERAGE/BREAKAGE
All goods received from us must be signed for as “UNEXAMINED as otherwise the carriers will not accept a claim for Pilferage/Breakage etc. We must receive your notification within such time so that we may register your claim with the carriers within three days of the date of delivery to you. (e) SHORT DELIVERY
Short delivery from the carriers must be notified to us in writing within seven days from the date shown on the Invoice/Contents Advice note. Any claims made outside the statutory period allowed cannot be accepted, and the amount involved will be due from you. (f) PRICES
This order will be delivered at the prices stated here-on, unless due to currency fluctuations, new duties, rising factory prices or Government Edicts, or any factors beyond our control, the valuation becomes too great to absorb, in which case supply can only be made at the applicable price at date of delivery (g) TITLE
1. The risk in the Goods shall pass to the buyers upon delivery.
2. Until full payment has been received by the sellers for all Goods whatsoever supplied at any time by
the sellers to the buyers,
(i) Property in the Goods shall remain in the sellers.
(ii) The buyers shall store the Goods separately and in such a way that they can be readily identified as being the property of the sellers.
(iii) The buyers shall be at liberty to sell the Goods in the Ordinary course of business on the basis that the proceeds of sale are in the property of and held on trust for the sellers.
(iv) The sellers may at any time revoke the buyer’s power of sale under (iii) above and the buyers shall thereupon permit the sellers to enter upon any premises where the Goods are located and to remove the same. (h) PENALTY FOR LATE PAYMENT
1. Interest will be charged on overdue accounts at 1 ½ % per month.
2. AU charges and costs relating to collection of overdue accounts will be charged to the buyers (i) CARRIAGE PAID
Carriage is paid on orders over £250 (£500 to these places: Channel Islands, Isle of Man, Eire and Northern Ireland). (j) PACK VARIATION
To ensure efficient service, it may sometimes be necessary to effect a product substitution or product variation. Any claim arising from this must be received by us in writing within seven days after delivery of the substituted or altered packs or specifications. (k) In the event of the customer going into liquidation, the director will be personally liable for any unrecovered debts. (I) LIMIT OF LIABILITY
In the event of any claim against us in respect of any matter whatsoever our liability (if any) shall be limited to the replacement of the goods sold by us in respect of which the liability arise. Under no circumstances whatsoever shall we be liable for any consequential loss or damage.
